1. Introduction and Scope
Extra Scapes LLC ("Extra Scapes," "we," "us," or "our") is committed to protecting the privacy of the individuals we work with. This Privacy Policy explains what information we collect, how we use and share it, how we protect it, and the choices available to you.
This Policy applies to information we collect through our website, in person, by phone, by text message, by email, through our project-management and scheduling software, and in the course of providing landscaping, hardscaping, pool, spa, and design services. By engaging our services, contacting us, or using our website, you acknowledge the practices described in this Policy.
This Policy does not modify, replace, or override the terms of any signed contract, proposal, change order, or service agreement between you and Extra Scapes. If any conflict exists between this Policy and a signed agreement, the signed agreement controls.

2. Information We Collect
Information you provide to us directly. This may include:
• Contact information such as your name, mailing address, service-property address, email address, and phone number(s);
• Property details necessary to design, quote, and perform services, including measurements, site conditions, photographs, sketches, and design preferences;
• Project and design materials, including renderings, plans, and specifications we prepare for you;
• Communications you send us, including texts, emails, voicemails, and messages submitted through our website or scheduling software;
• Billing information and records (payment-card and bank-account details are collected and processed by our third-party payment processors and are not stored by Extra Scapes); and
• Any other information you choose to provide.
Information we collect automatically. If you visit our website, we and our service providers may automatically collect certain technical information, such as your IP address, device and browser type, pages viewed, and interactions with the site, through cookies and similar technologies. You can control cookies through your browser settings; disabling them may affect site functionality.
Information from third parties. We may receive information from referral sources, subcontractors, public records, and platforms you use to contact or pay us.

3. How We Use Your Information
We use the information we collect to:
• Provide, design, quote, schedule, perform, and improve our services;
• Process payments and manage billing, invoicing, and collections;
• Communicate with you about quotes, appointments, projects, service requests, and inquiries;
• Send service-related and, where permitted, promotional or marketing communications;
• Maintain internal records and manage and operate our business;
• Document our work, including for portfolio, marketing, and quality-control purposes, subject to Section 5;
• Establish, exercise, or defend legal claims, enforce our agreements, resolve disputes, and prevent fraud or misuse; and
• Comply with applicable law, regulations, and lawful requests.

4. Communications and Consent
Service communications. When you engage us or request information, you consent to receive communications related to your project, account, quotes, scheduling, and service — by phone, text, and email — at the contact information you provide.
Marketing communications. With your consent where required, we may send promotional messages, seasonal offers, and similar marketing by email or text. You may opt out of marketing emails at any time by using the unsubscribe link, and opt out of marketing texts by replying STOP. Message and data rates may apply, and message frequency varies. Opting out of marketing does not stop service-related communications necessary to your active project or account.
Telephone and text consent. By providing a phone number, you consent to be contacted at that number by Extra Scapes for the purposes described in this Policy. You represent that you are the subscriber or customary user of any number you provide. We do not sell or share your phone number with third parties for their own marketing.

5. Photographs, Designs, and Project Media
In the ordinary course of business, Extra Scapes creates and retains photographs, videos, renderings, drone footage, and design materials documenting project sites and completed work.
Use of project imagery. Unless you notify us otherwise as described below, you agree that Extra Scapes may use photographs, video, and renderings of project work — including before, during, and after images — for its portfolio, website, social media, advertising, and other promotional purposes. We do not publish a client's full street address or identify clients by name in marketing materials without consent.
Opting out / removal requests. If you do not want imagery of your project used for marketing, or you wish to request removal of specific previously published imagery, contact us using the information in Section 14. We will honor reasonable removal requests on a going-forward basis. We are not able to recover or control material that has already been downloaded, shared, reposted, or republished by third parties.
Ownership of designs. All renderings, plans, drawings, and design materials prepared by Extra Scapes remain the intellectual property of Extra Scapes unless ownership is expressly transferred in a signed writing. Receiving a design does not grant the right to reproduce, distribute, claim authorship of, or use those materials to solicit competing bids except as permitted by your signed agreement.

6. How We Share Information
Extra Scapes does not sell, rent, or lease your personal information to third parties for their own marketing. We share information only as follows:
• Service providers and vendors who support our business — for example, payment processors, project-management and scheduling software (such as our customer-management platform), accounting and tax professionals, communication and marketing tools, and subcontractors or trade partners who need information to perform work on your project. These providers are permitted to use the information only to provide services to us.
• Legal and protective disclosures — when we believe in good faith that disclosure is necessary to comply with a law, regulation, subpoena, court order, or other legal process; to enforce our agreements; to establish, exercise, or defend legal claims; to collect amounts owed; or to protect the rights, property, or safety of Extra Scapes, our clients, employees, or the public.
• Business transfers — in connection with a merger, sale, financing, or transfer of all or part of our business.
• With your direction or consent.

7. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide services, maintain records, comply with our legal, tax, and accounting obligations, enforce our agreements, and establish, exercise, or defend legal claims.
Even where you request deletion, we may retain information that we are permitted or required to keep — including information reasonably necessary to complete a transaction, comply with a legal obligation, resolve disputes, prevent fraud, enforce our agreements, defend or pursue legal claims, or maintain business and financial records. We will retain such information only for as long as the applicable purpose requires.

• Imagery opt-out — opt out of marketing use of project imagery as described in Section 5.
How to submit a request. Contact us using the information in Section 14. To protect your information, we will take reasonable steps to verify your identity and your relationship to the information before responding, and we may decline requests that we cannot reasonably verify.
We may also decline or limit requests that are unfounded, excessive, repetitive, fraudulent, or abusive, or where an exception under applicable law applies. We will not discriminate against you for exercising a right you are entitled to under applicable law.
Depending on your state of residence, you may have additional rights under your state's privacy laws (for example, residents of California and certain other states). Where such laws apply to us, we will honor the rights they provide. To exercise any such right, submit a request as described above and identify your state of residence.
